Yes, you can get married after divorce.
But the earlier marriage must have legally ended before the new marriage happens.
The key rule
We cannot solemnise the marriage until the divorce is final.
If your divorce is still pending
You can often still:
- prepare the NOIM
- lodge the NOIM
- organise your documents
But the marriage itself cannot happen until the divorce is final.
What documents we need
Usually we need:
- the divorce order, or
- another proper court record showing the divorce is final
If the divorce was overseas, we may need extra documents and a translation.
Australian divorces
For most Australian divorces, the divorce becomes final one month and one day after the court makes the order, unless the court orders otherwise.
Practical tip
If your divorce timing is tight, do not lock yourself into a marriage date too early.
Wait until you are confident the divorce will be final in time.
